Shayona Enterprise ("we", "us", "our") operates shayonagifts.com (the "Site"), an online store for personalized and laser-engraved gifts, wooden home decor, spiritual items, and corporate gifting products. This Privacy Policy explains what Personal Information we collect when you visit the Site, place an order, or request customization/engraving on a product, and how we use, share, and protect that information.

1. Consent and Scope

By browsing the Site, creating an account, placing an order, or otherwise submitting your Personal Information to us, you consent to the collection, use, and disclosure of that information as described in this Privacy Policy. If you do not agree with this Policy, please do not use the Site.

This Policy applies to shayonagifts.com and does not cover information collected offline (for example, at trade fairs or over a phone call) unless stated otherwise, or the practices of third parties we do not control.

For the purposes of India's Digital Personal Data Protection Act, 2023, Shayona Enterprise acts as the Data Fiduciary in respect of the Personal Information described in this Policy.

2. Personal Information We Collect

a) Device and usage information

Collected: browser version, IP address, approximate location/time zone, cookie identifiers, pages and products viewed, search terms, referring site, and how you interact with the Site.

Purpose: to display the Site correctly, secure our checkout, and analyze traffic to improve the Site and product catalog.

Source: collected automatically via cookies, log files, pixels, and similar technologies.

b) Order and account information

Collected: full name, billing and shipping address, phone number, email address, and payment details (processed by our payment gateway; we do not store full card numbers).

Purpose: to fulfil your order, process payment, arrange courier/shipping, send order confirmations and invoices, handle returns/exchanges, screen for fraud, and (where you've opted in) send offers relating to our products.

c) Personalization and engraving details

Because many of our products are name-engraved, photo-printed, or made-to-order, we may also collect: names, initials, dates, uploaded photos/images, and custom text or design instructions you submit for engraving or printing.

Purpose: solely to manufacture and personalize the product you have ordered. Uploaded images/text are used only for that order and are not used for any other purpose without your consent.

d) Customer support information

Purpose: to respond to queries, resolve complaints, and process returns/refunds.

3. Minors

The Site is not directed at individuals under the age of 18. We do not knowingly collect Personal Information from children. If you are a parent or guardian and believe your child has shared Personal Information with us, please contact us at the address below so we can delete it.

4. How We Share Personal Information

We do not sell your Personal Information. We share it only as needed to run our business:

  • Shopify — powers our online store, checkout, and payments. See Shopify's privacy policy.
  • Courier/logistics partners — to deliver your order (name, address, phone number only).
  • Payment gateway(s) — Razorpay / PayU / Shopify Payments (whichever is enabled at checkout) — to process payment securely; we do not receive or store your full card, UPI, or bank details. These are held directly by the payment gateway under its own privacy policy.
  • Google Analytics, Meta (Facebook/Instagram) Pixel, and other advertising partners — as described in Section 10 below.
  • Legal authorities — where required to comply with law, a court order, or to protect our rights, or those of our customers.

5. WhatsApp, SMS, and Email Marketing

With your consent, we may contact you via WhatsApp, SMS, or email to send order updates, delivery notifications, and promotional offers on our personalized and gifting products.

  • Order/transactional messages (order confirmation, shipping updates, delivery OTPs) are sent automatically and are necessary to fulfil your order.
  • Promotional messages (offers, new arrivals, discount codes) are sent only if you have opted in — for example, by subscribing on our Site or providing your number at checkout.
  • You can opt out of promotional WhatsApp/SMS/email messages at any time by replying "STOP"/"UNSUBSCRIBE", using the unsubscribe link in our emails, or contacting us using the details in Section 18. Opting out does not affect transactional messages related to an active order.

6. Newsletter Subscription

If you subscribe to our newsletter ("Join the Laser Art community"-style sign-up), we collect your email address to send updates about new products, offers, and promotions. You can unsubscribe at any time using the link at the bottom of any marketing email, or by contacting us directly.

7. Customer Reviews and User-Generated Content

If you submit a product review, testimonial, or photo, we may display your name (or the name you provide) and your review content publicly on the Site. Please do not include sensitive personal information in a review. You may request removal of a published review by contacting us using the details in Section 18.

8. Social Media Plugins and Pixels

We may use tools such as the Meta (Facebook/Instagram) Pixel and similar technologies to measure the effectiveness of our ads and show you relevant offers on those platforms. We retain your order and account information for as long as needed to fulfil the purpose it was collected for — including to meet our accounting, tax, and legal record-keeping obligations under Indian law — and after that for as long as necessary to resolve disputes and enforce our agreements. You may request earlier deletion; see Section 14.

We use industry-standard safeguards (including SSL encryption at checkout, restricted internal access, and secure hosting through Shopify) to protect your Personal Information. However, no method of transmission or storage over the internet is 100% secure, and we cannot guarantee absolute security.

In the unlikely event of a data breach that risks your rights or interests, we will notify affected customers and the relevant authority without undue delay, as required under applicable Indian law, and will describe the nature of the breach and the steps we are taking in response.

13. International Customers and Cross-Border Data Transfer

If you place an order from outside India, your Personal Information will still be collected and processed as described in this Policy. Some of our service providers (such as Shopify and our payment/analytics partners) may store or process data on servers located outside India. This Privacy Policy and any dispute arising from it are governed by the laws of India, and courts at Gandhinagar/Surat, Gujarat shall have exclusive jurisdiction, subject to applicable consumer protection laws that permit you to approach a forum in your own place of residence.

We do not use your Personal Information for any automated decision-making that produces a legal or similarly significant effect on you (for example, we do not use automated profiling to deny you service).

If any provision of this Policy is found to be unenforceable, the remaining provisions will continue in full force and effect.
